About these terms

These Terms of Use (the “Terms”) are an agreement between you and Asad Ansari, the developer of Plateful (“we”, “us” or “our”). They cover the Plateful app for iPhone, its widgets and Siri shortcuts, and the online service behind them (together, “Plateful”). By downloading or using Plateful you agree to these Terms. If you do not agree, do not use Plateful.

Our Privacy Policy explains what information Plateful collects and how it is used, and forms part of these Terms. If you downloaded Plateful from the App Store, Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) also applies. These Terms add to it and do not replace it.

Who can use Plateful

You must be at least 13 years old to use Plateful. If you are under the age of majority where you live, use Plateful only with the permission of a parent or guardian, who accepts these Terms for you.

What Plateful is

Plateful is a calorie and macronutrient tracker. It estimates what is in a meal from a description, a photo, a barcode or a nutrition label, and keeps a log of what you confirm.

Every number Plateful shows is an estimate for informational purposes. It is not medical, nutritional or dietary advice, and it is not a substitute for a doctor, dietitian or other qualified professional. Do not rely on it to manage a medical condition, an allergy or an eating disorder.

The meal score is a guide computed from a meal's nutrients, its size and where its numbers came from. It is not a health rating and not medical advice.

Health and safety

Talk to a doctor before you start a diet or change how you eat, especially if you are pregnant or breastfeeding, are under 18, have a medical condition, or have or have had an eating disorder. Suggested daily targets, adaptive targets and energy-balance figures come from general formulas and what you enter, and may not suit you.

Estimates can be wrong about what a meal contains, including allergens. Never rely on Plateful to decide whether a food is safe for you to eat. If you think you may have a medical emergency, call your doctor or emergency services immediately.

Estimates and food data

Plateful estimates meals with models on your iPhone, its built-in food table and, when you allow it, models in the cloud. Portions, recipes and ingredients vary, and automated models make mistakes. Check an estimate before you confirm it, and correct it when it is wrong. We do not promise that any estimate, food record or target is accurate, complete or right for you.

Nutrition figures come from USDA FoodData Central (public domain), Health Canada's Canadian Nutrient File and Open Food Facts (Open Database License, https://opendatacommons.org/licenses/odbl/1-0/). Contains information licensed under the Open Government Licence – Canada. Source: Canadian Nutrient File, Health Canada, 2015. The licence is at https://open.canada.ca/en/open-government-licence-canada. Open Food Facts is community-maintained, so a scanned product's numbers come from whoever entered them. Check the packet if something looks wrong.

Your account

An account is optional. Without one, your log stays on this iPhone. If you sign in with Apple, your food log and daily targets are backed up to your account so they can be restored and synced to your other devices.

You are responsible for the device and Apple Account you sign in with, and for what happens under your Plateful account. Tell us promptly if you think someone has used it without your permission.

You can sign out at any time, and delete your account and everything synced to it under Settings, Account. Deletion is permanent. The Privacy Policy lists the few records that remain afterwards and why.

Cloud estimation

Cloud estimation is optional and needs a Plateful account. When it is on, some meals are estimated by Anthropic's Claude through Plateful's server, as the Privacy Policy describes. On some iPhones a second opinion can instead come from Apple's Private Cloud Compute, which Apple operates under its own terms.

Each account has a monthly allowance of cloud estimates, shown in the app. Plateful Pro raises it. Unused estimates do not carry over, and deleting and recreating an account does not reset the allowance. We may change the allowance, or limit or pause cloud estimation, to prevent abuse, keep the service running or control its cost; the current allowance is always shown in the app.

Plateful Pro

Plateful is free to use. Logging, the food table, barcodes, nutrition labels, estimation on your iPhone, widgets, Apple Health, sync, Progress and meal reminders are free and stay free. Plateful Pro is an optional auto-renewing subscription that adds a larger monthly cloud-estimation allowance; the choice to have Claude estimate every meal (Automatic remains the default and stays free); Insights (why a meal scored what it did, the swap that would raise it, and patterns across your last four weeks); adaptive targets (a suggested change to your daily target from your weight trend, applied only when you accept it); the PDF progress report; and new features as they are released, such as the coach. The current price, the billing period and what Pro includes are shown in the app before you subscribe.

Pro is billed by Apple through your Apple Account, not by us. Payment is charged to your Apple Account when you confirm the purchase or, if you start with a free trial, when the trial ends. The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period, and your Apple Account is charged for the renewal within the 24 hours before that period ends. Cancel or change it at any time under Subscriptions in your iPhone's Settings; you keep Pro until the end of the period you paid for. Refunds are handled by Apple under Apple's terms.

A free trial, when offered, is available once per Apple Account, and any unused part of it ends when you buy a subscription. If the price changes, Apple tells you before the new price applies and, where the law requires, asks you to agree to it.

You do not need a Plateful account to subscribe. Subscribing is tied to your Apple Account and shared with your Family Sharing group if you have one. Nothing you have logged is ever removed or hidden if a subscription ends.

Acceptable use

Use Plateful only to track your own meals and progress, and only as the law allows. Do not:

  • access, or try to access, another person's account or data;
  • interfere with, overload or disrupt Plateful or the services it relies on, or get around its limits, including the cloud-estimation allowance;
  • send requests to Plateful's server other than through the app;
  • copy, modify, reverse engineer or resell the app or its food table, except where the law expressly allows it;
  • submit anything unlawful, or anything that infringes someone else's rights.

We may suspend or close an account that breaks these rules or is used to abuse the service.

Your content

What you put into Plateful — meal descriptions, photos, notes, reports and your log — stays yours. You give us a limited permission to store, copy, process and transmit it only as needed to run Plateful for you: for example, to sync your log, to send a meal to a cloud model when you have turned that on, or to look into a report you send.

If you send us feedback or suggestions, we may use them to improve Plateful without owing you anything for them.

Our intellectual property

Plateful, including its software, design, food table, text and graphics, belongs to us or to our licensors and is protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable and revocable licence to use the app on Apple devices you own or control, under these Terms and the App Store's usage rules. We keep every right we do not expressly give you.

Apple, iPhone, Apple Health, Siri and Apple Intelligence are trademarks of Apple Inc. Claude is a trademark of Anthropic. Plateful is not affiliated with or endorsed by Apple, Anthropic, the USDA, the Government of Canada or Open Food Facts.

Services we rely on

Plateful depends on services run by others: Apple (the App Store, Sign in with Apple, Apple Health, notifications and Private Cloud Compute), Supabase (hosting) and Anthropic (cloud estimation). Your use of Apple's services is also governed by Apple's terms. We are not responsible for services we do not control, and a feature that depends on one may change or stop if that service does.

Changes and termination

We may add, change or remove features, and we may stop offering Plateful or any part of it. If we stop offering Plateful Pro, renewals stop and you keep Pro until the end of the period you paid for.

You can stop using Plateful at any time by deleting your account and the app. We may suspend or end your access to Plateful's online service if you break these Terms, if the law requires it, or if we stop offering the service. The sections on content, intellectual property, disclaimers, liability, indemnity and governing law continue to apply after that.

Disclaimers

To the fullest extent the law allows, Plateful is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that Plateful will be uninterrupted, error-free or secure, or that any estimate will be accurate.

Some places do not allow these exclusions, so some may not apply to you. Nothing in these Terms limits rights you have as a consumer that the law says cannot be limited.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from or related to Plateful, including any reliance on an estimate. Our total liability for any claim relating to Plateful is limited to the greater of what you paid for Plateful Pro in the 12 months before the claim arose and 50 Canadian dollars.

These limits do not apply to liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.

Indemnity

To the extent the law allows, you agree to compensate us for reasonable losses and costs, including legal fees, that result from a claim against us arising from your breach of these Terms or your misuse of Plateful.

Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of Ontario have exclusive jurisdiction over any dispute arising from these Terms or Plateful, except where the law of the place you live gives you the right to bring a claim in your local courts or requires that its own law apply.

Before starting a claim, please email us at support@platefulhq.com so we can try to resolve the problem informally.

Apple and the App Store

If you downloaded Plateful from the App Store, you also acknowledge that:

  • these Terms are between you and us, not Apple, and Apple is not responsible for Plateful or its content;
  • Apple has no obligation to provide maintenance or support for Plateful;
  • if Plateful fails to meet any warranty that applies, you may tell Apple, and Apple will refund the purchase price, if any; to the fullest extent the law allows, Apple has no other warranty obligation for Plateful;
  • Apple is not responsible for any claim relating to Plateful, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection or privacy law;
  • Apple is not responsible for investigating, defending, settling or discharging any claim that Plateful infringes someone's intellectual property rights;
  • you are not located in a country subject to a United States Government embargo or designated as a “terrorist supporting” country, and you are not on any United States Government list of prohibited or restricted parties;
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.

General

These Terms and the Privacy Policy are the whole agreement between you and us about Plateful. If a court finds part of them unenforceable, the rest stays in effect. If we do not enforce a provision, we have not waived it. You may not transfer your rights under these Terms. We may transfer ours to whoever takes over Plateful, who must honour them.

Changes to these terms

We may update these Terms. The date at the top shows when they last changed. If a change matters, we will tell you in the app and ask you to agree again before you next sign in or connect Apple Health. If you keep using Plateful after a change takes effect, you accept the updated Terms. The current version is always available in the app under Settings, About, and at https://platefulhq.com/terms/.
